Terms and Conditions for Telemedicine Services

Thank you for choosing our telemedicine service. This Terms and Conditions page (the “Agreement”) is a legal contract between you, the patient, and our telemedicine service. Please read the terms of this Agreement carefully before using our service. By using our service, you agree to be bound by this Agreement. If you do not agree to any of the terms in this Agreement, do not use the service.

Our Service: Our telemedicine service provides medical consultation and treatment services through video, audio, and messaging technology, as well as other communication methods, as appropriate. Our services are provided by a certified, licensed medical professional. Our telemedicine service is not a substitute for in-person medical consultations, and we do not provide medical services or advice for emergency care.

Privacy: We take your privacy very seriously. We comply with all federal and state health privacy laws, including HIPAA. We respect your privacy and will keep your personal information confidential. We do not share your information with any third party, except when required by law, or when you give us permission to share your information. Please refer to our Privacy Policy for more information.

Payment: Payment for our services is due at the time of service. We accept all major credit cards and electronic payment options. We do not accept insurance payments, but we can provide an invoice to help you obtain insurance reimbursement. Our fees are listed on our website.

Eligibility: Our services are available to children and adults in the state of Alabama only. We reserve the right to refuse service to any individual for any reason.

No Guarantee: Our telemedicine service makes no guarantees, either express or implied, as to the outcome of consultations or treatments. We are not responsible for any outcomes or side effects that may occur as a result of your use of our service.

By using our telemedicine service, you acknowledge and agree that:

1. The telemedicine service is provided for an adult or child in non-emergency settings only.

2. The telemedicine service is not a substitute for necessary medical examination or care by a health care provider.

3. The telemedicine service is not an emergency room or acute care facility.

4. You are responsible to follow any instructions given to you by the telemedicine health care provider.

5. In an emergency, you must seek medical attention immediately and not rely on telemedicine services.

6. You must provide truthful and relevant information about your medical history and current symptoms to enable an accurate diagnosis and treatment plan.

7. There are limitations to the telemedicine service, including the fact that we cannot provide in-person examination, testing or treatment.

8. The telemedicine service healthcare provider may refuse to provide services if they determine that it is not appropriate or safe to do so.

9. You must not share passwords or other access codes to anyone.

10. You must inform us immediately if you believe there has been unauthorized access of your account.

11. You acknowledge that our services may be interrupted, delayed or otherwise disrupted due to technical difficulties, and we will not be responsible for any loss or harm that may result.

12. We may modify this Agreement at any time without notice. Your continued use of our service following any modifications constitutes your acceptance of those modifications.

Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the State of Alabama, USA. Any legal action arising out of or relating to this Agreement shall be filed in a court located in Alabama.

Final Note: This Agreement represents the entire agreement between us and supersedes all prior agreements, understandings or negotiations, whether written or oral. This Agreement may not be modified or amended except in writing signed by both parties.

Thank you for using our Telemedicine Service. Please read below for more detailed information regarding the specifics of our service.

  1. Telehealth Visits

    a. Appointments: All appointments for mental health are virtual/telehealth only and are made for patients residing in the state of Alabama only. Appointments can be phone calls or dual visual/audio based on patient preference and availability. Appointments can be scheduled for as soon as next day based on availability and provider acceptance. All intake forms must be completed prior to first appointment. Appointments must also be confirmed prior to start time through either email or text. Any appointment that has not been confirmed and/or intake forms have not been completed may be cancelled by the provider/staff up to 24 hours prior to the appointment time without prior notification to the patient. New patient appointments must be at least 30 minutes in duration to allow time to establish care. Provider may reschedule or cancel appointments without prior notice based on availability, lack of form completion by the patient, inappropriateness of appointment, or any other reason deemed sufficient by provider. Rescheduled or cancelled appointments are subject to full money back refund based on policy as outlined below. Provider may also fire patients based on inappropriateness, tardiness as outlined below, or any other reason deemed sufficient by provider.

b. Payments: Payments should be paid in full after scheduling an appointment prior to the appointment start time. Currently, insurance plans are not accepted, and all services are self-pay only. Payments may be made in cash through Zelle Pay or Venmo, or through credit card with an additional 3% fee per transaction. Any concerns with payment/transaction errors must be disputed with bank and/or third party sources. Patients who have not paid in full prior to the appointment start time may be subject to cancellation by the provider/staff. Patients with outstanding debts may also be subject to cancellations or denial of future appointments until balance is paid in full regardless of the amount owed.

c. Cancellations: Cancellations as late as 24 hours prior to appointment time will not be charged or will be provided with a full refund if payment has already been made by patient. Any other cancellation, including emergency cancellations or cancellations less than 24 hours prior to appointment, are not entitled to refund and may be subject to full or partial refund based solely on provider’s discretion.

d. Late/No Show: Any patient who does not answer when called for an appointment time/enter telehealth appointment at their appointment time has exactly 1/2 of that appointment duration to return the call/enter the appointment platform. For example, a patient has 7 minutes to call/enter the appointment for a 15 minute appointment before they are marked as “No Show”; a patient has 15 minutes to call/enter the appointment for a 30 minute appointment before they are marked as “No Show”. Any patient who is late may begin the encounter late as long as they call/enter the appointment within this time frame, and we will continue with the appointment as scheduled until the rest of the appointment time has lapsed. Any “No Shows” will not be entitled to a refund and will be charged the cost of the appointment. A patient who has more than three “No Shows” without an excuse deemed sufficient by the provider may be subject to being fired from the practice or may be subject to a suspension period at the discretion of the provider.

e. Rescheduling: Appointments can be rescheduled up to 24 hours prior to visit. If an appointment is rescheduled within this time frame and made to be of a different duration, the difference in price will be accounted for- the difference will either be reimbursed if the new appointment price is less than the original price and the payment for the original appointment has been made, or the difference will be paid by the patient if the new appointment price is greater than the previous price. Please discuss any concerns directly with provider through email and allow 24-48 hours for a response. There will be no guarantees that a patient will be able to reschedule to a sooner appointment that becomes available if fees, forms, etc are not completed in full prior to scheduled appointment. If an appointment is rescheduled after 24 hours prior to original visit, no refund will be provided for the original visit and the patient will need to pay for two visits (original and rescheduled date).
